Diddy could be on the verge of scoring a big win in his sex trafficking trial before opening statements have even begun.

Prosecutors admitted in court that an anonymous witness, named in legal documents as “Victim No. 3”, may not turn up and testify in the trial.

The alleged victim, who is a woman, does not live near New York, where the trial is being held.

As a result, prosecutors are saying she may not appear to testify even if she is formally subpoenaed by the court.

They also admitted that they were now having trouble reaching the woman and her attorney.

During the hearing, the judge asked prosecutors if the potential witness would be featured in opening statements but lead prosecutor, Maurene Coney, said that the woman’s story was not due to come up until the second half of the trial.

Coney also said that they planned on describing the woman as someone who had been abused and sexually exploited by Diddy.

Diddy’s legal team said that they needed to know whether the potential witness was going to show by the end of the week while the judge told the prosecution to make every effort to secure the woman’s appearance in court.

On the first day of his sex trafficking trial, which was devoted primarily to jury selection, Diddy admitted to the judge that he was nervous.

He said: “I’m sorry your honor, I’m a little nervous today.”

The Bad Boy Records founder made the admission around 90 minutes into the selection process as he requested a brief break to go to the bathroom.

The judge initially refused Diddy’s request but quickly changed his mind and allowed the record executive to go to the toilet.

The jury selection process has seen potential jurors questioned about if they are aware of some of the high profile people involved in the case such as Dawn Richard and Aubrey O’Day.

Potential jurors have also been asked if they recognize celebrity names such as Kanye West, Michael B. Jordan and Mike Myers.

During the process, Diddy could be seen communicating with his attorneys about whether they should dismiss certain jurors or not.

Jury selection for the highly-publicized case is expected to last around a week with opening statements tentatively scheduled for May 12.
